Bolshikho — Terms & Conditions

1. Acceptance of these terms

These Terms & Conditions form an agreement between you and Spectrotags Technologies Private Limited about your use of the Bolshikho mobile application.

By downloading, installing or using Bolshikho, you confirm that you have read these terms and agree to be bound by them. If you do not agree with any part of them, please do not use the app, and uninstall it if it is already on your device.

These terms should be read together with the Bolshikho Privacy Policy, which explains what the app does and does not collect and forms part of this agreement.

2. About Bolshikho

Bolshikho is an English learning application for Android. It offers structured lessons, everyday vocabulary, pronunciation practice, quizzes and progress tracking, aimed at learners in India who want to use English with more confidence.

It is published by Spectrotags Technologies Private Limited, a private limited company registered in India, trading under the brand name AppMedia India. In these terms, “we”, “us” and “our” mean that company; “you” means the person using the app.

You can reach us at any time at support@appmediaindia.com, which is our only contact channel.

3. Your licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use one copy of Bolshikho on a device that you own or control, for your own personal, non-commercial learning.

This licence does not transfer ownership of anything. We and our licensors keep all rights in the app that are not expressly granted to you here.

Unless the law of your country gives you a right that cannot be excluded by agreement, you must not:

• copy, modify, adapt, translate or create derivative works from the app;
• reverse engineer, decompile or disassemble the app, or attempt to derive its source code;
• rent, lease, lend, sell, redistribute or sublicense the app;
• remove, obscure or alter any copyright, trade mark or other proprietary notice;
• distribute a modified version of the app, or publish it on any store or website other than the official Google Play listing.

The licence ends automatically if you break these terms. You may end it at any time by uninstalling the app.

4. The app is free

Because nothing is sold to you through the app, there is nothing to be billed for, nothing to cancel and no refund to claim. We fund the app through the advertising described in section 8.

If any third party ever asks you to pay for Bolshikho, or offers a “full” or “unlocked” version of it, that offer does not come from us. Please tell us at once so we can report it.

5. Acceptable use

You agree to use Bolshikho only for lawful purposes and only in the way it is intended to be used. In particular, you agree not to:

• use the app in a way that breaks any applicable law or regulation in India or in your own country;
• interfere with, disrupt or place an unreasonable load on the app or on any server or network it relies on;
• attempt to gain unauthorised access to any part of the app, our systems or the systems of our service providers;
• introduce a virus, trojan, worm or any other malicious or technologically harmful material;
• use an automated system, script or bot to interact with the app;
• use the app to infringe anyone else's intellectual property, privacy or other rights;
• extract, scrape or systematically collect the lesson content for republication or for any commercial purpose;
• use the app in a way that could damage, disable or impair it for other users.

If we reasonably believe you are using the app in breach of this section, we may take proportionate steps to stop it, including withdrawing your licence and, where the conduct is unlawful, reporting the matter to the appropriate authority.

6. Intellectual property in lesson content

All content in Bolshikho — lesson text, exercises, explanations, example sentences, curated word lists, audio, illustrations, icons, the user interface, the name “Bolshikho”, the AppMedia India brand and the underlying software — is owned by Spectrotags Technologies Private Limited or used by us under licence. It is protected by copyright, trade mark and other intellectual property laws in India and internationally.

You may use the lesson content for your own learning. You may not reproduce, publish, broadcast, distribute, sell, adapt or make it available to the public, in whole or in part, in any medium, without our written permission. This applies whether or not you charge for it.

Nothing in these terms transfers any intellectual property right to you, and no right is granted by implication.

Where the app quotes or refers to third-party material, that material remains the property of its owner. If you believe anything in Bolshikho infringes your copyright or other right, write to support@appmediaindia.com with details of the material, the right you hold and where the material appears. We investigate every such notice and remove infringing material where the claim is made out.

7. No guarantee of learning outcomes

We do not promise or guarantee that using the app will improve your English by any measurable amount, within any timeframe, or at all. Language learning depends on how often and how carefully you practise, your starting level, your first language, your goals and many other factors that are outside our control.

The app does not award any qualification, certificate, diploma, score or accreditation that is recognised by any school, university, examination board, employer or government body. Progress indicators inside the app measure your activity within the app only; they are not an assessment of your ability.

We take care to make lesson content accurate and useful, but language is nuanced and regional usage varies. We do not warrant that every explanation, translation or example is complete, current or suitable for every purpose, and you should not rely on the app as your only source for anything that matters. If you spot a mistake, please tell us and we will correct it.

8. Advertisements and third-party links

Bolshikho is free, and advertising is how we pay for it. The app displays advertisements supplied by Google AdMob. Section 6 of the Privacy Policy explains what data is involved and how to turn off ad personalisation on your device.

Advertisements are selected and served by Google, not chosen by us individually. We do not endorse, guarantee or take responsibility for any advertised product, service, offer or advertiser. Any dealing you have with an advertiser is between you and that advertiser alone, and we are not a party to it.

The app may also contain links that take you to websites or applications we do not operate. Those destinations have their own terms and their own privacy policies, which you should read. We have no control over their content, availability, security or practices and accept no responsibility for them.

Please use ordinary caution with advertisements and external links: never provide payment details or sensitive personal information to a third party you do not trust, and be sceptical of any advertisement claiming to be from us.

9. Your device and your data

You are responsible for the device you use, for your internet connection and for any data charges your mobile operator applies when the app downloads content or loads advertisements.

Your learning progress is stored locally on your device. It is not backed up to us or to any server we control. If you uninstall the app, clear its data, reset your phone, lose your phone or move to a new device, that progress is permanently gone and we cannot restore it. This is a consequence of the app not requiring any registration, and it is deliberate: it means we never hold your learning history.

You are responsible for keeping your device secure and up to date. We are not liable for loss of data caused by device failure, theft, malware, an operating system upgrade, or your own actions.

10. Availability and changes to the app

We aim to keep Bolshikho available and working, but we do not guarantee that it will be available without interruption or free of faults. Availability can be affected by your device, your network, your Android version, Google Play, or maintenance work.

We may, at any time and without liability to you:

• add, change, suspend or remove any feature, lesson, word set or other content;
• release updates, which you may need to install for the app to keep working correctly;
• stop supporting older Android versions or older versions of the app; or
• withdraw the app from distribution entirely.

If we decide to discontinue Bolshikho, we will give reasonable notice through the app or the Play Store listing where we practically can. Your locally stored progress would remain on your device until you remove it.

11. Disclaimer of warranties

To the fullest extent permitted by law, Bolshikho is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory.

We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the app will meet your requirements, that it will operate without interruption or error, that defects will be corrected, or that the app or the systems that deliver it are free of harmful components.

Nothing in these terms excludes or limits any right or remedy you have under the Consumer Protection Act, 2019 or any other law of India that cannot lawfully be excluded. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Spectrotags Technologies Private Limited, its directors, employees and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, loss of learning progress, loss of profit, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with your use of, or inability to use, Bolshikho — whether the claim is brought in contract, tort (including negligence), statute or otherwise, and even if we have been advised that such loss was possible.

Bolshikho is supplied free of charge. Accordingly, and to the fullest extent permitted by law, our total aggregate liability to you for all claims connected with the app is limited to INR 1,000 (one thousand Indian Rupees).

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

13. Indemnity

You agree to indemnify and hold harmless Spectrotags Technologies Private Limited and its directors and employees against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising from your misuse of the app, your breach of these terms, or your infringement of the rights of any other person.

We will notify you promptly of any claim to which this section applies and will not settle it without consulting you.

14. Changes to these terms

We may revise these terms from time to time — for example, when the app gains a feature, when we change how it is funded, or when the law changes. The current version is always published at this URL, with its effective date and last-updated date shown at the top of the page.

Where a change materially affects your rights or obligations, we will give notice inside the app or on the Play Store listing before it takes effect. Continuing to use Bolshikho after a revised version takes effect means you accept it. If you do not accept it, please stop using the app and uninstall it.

15. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or with your use of Bolshikho (including non-contractual disputes or claims), are governed by and interpreted in accordance with the laws of India, without regard to conflict of law rules.

The courts at Ghaziabad, Uttar Pradesh, India have exclusive jurisdiction to settle any such dispute or claim, and you and we submit to that jurisdiction.

If you are a consumer, this does not deprive you of the protection of any mandatory consumer law of the country in which you live, including any right to bring proceedings in your local courts where the law gives you that right.

Before going to court, please write to us. Most issues are resolved quickly by email, and we would rather fix a problem than litigate it.
